L’examen et l’adoption du projet de loi “Grenelle de l’environnement” devraient être renvoyés à l’automne en raison d’un calendrier législatif surchargé.

Le texte, qui comprend une large part liée au bâtiment, a reçu le 28 mai dernier l’avis positif du Conseil Èconomique et social et devrait être examiné ce 11 juin prochain en Conseil des ministres.

The examination and adoption of the “Grenelle de l’Environnement” environmental law will be postponed until the autumn due to an overloaded legislative calendar. The text, which includes a large building related part, received a positive assessment from the Economic and Social Council last 28 May and will be examined by the Council of Ministers on 11 June. Grenelle 1 takes up the essential part of the conclusions of the “Grenelle de l’Environnement” environmental round table on energy, building, transport, agriculture and nature protection. It will be followed by Grenelle 2 and 3 laws that will set out the technical implementation of the measures.

In the property field, this programme law is rich in novelties. The property sector, which is responsible for 40% of final energy consumption and 25% of greenhouse gas emissions, occupies a prime position in the new provisions that will be discussed in Parliament from June onwards.

The main measure covers the obligation, from the end of 2010, to design public and tertiary buildings according to “low consumption” standards, meaning consuming less than 50 kWh per year per square metre on average. At the end of 2012, all applications for building permits will be subject to the “low consumption building” standard. By 2020, MEDAD, the Ecology, Development and Sustainable Development Ministry, intends to submit all new construction to the “positive energy” standard. Currently, the government is setting the objective of reducing the energy consumption of buildings by 38 % between now and 2020.

Whilst expecting mobilisation of private players, the State is promising to set an example. So, all buildings belonging to the State and its Public Establishments will be subject to an energy audit by 2010 and will be required to start the renovation of buildings by 2012 at the latest.

Objective: Reduce the energy consumption of these buildings by at least 40% within ten years and their greenhouse gas emissions by at least 50 %. This is an enormous project, with some 120 million m2 affected (including 70 millions m2 for local authorities). In the tertiary sector, “the owners of large tertiary buildings, notably property companies, will be subject to “energy saving certificate” provisions”, according to the bill, which does not provide more detail.
